In compliance with the decision issued on 8 April 2009 regarding “Provisions on Corporate Mergers and Split-Ups” published in Official Journal no.106 dated 9/05/2009, we inform you that, as of 1 May 2019, pursuant to Regional Law no. 1 of 16 March 2018 “Rationalization of in-house companies of the Emilia-Romagna Region”, ASTER S.Cons. p.A. and ERVET S.p.A. were merged in accordance with article 2501 of the Italian Civil Code. As a result of such merger, the new company named ART-ER S-con.p.a. replaces ASTER S.Cons. p.A. and ERVET S.p.A. as Data Controller, pursuant to articles 4.7 and 25 of Regulation EU 2016/679, without any changes in the purposes and modalities of processing described in their privacy notices. Similar effects are produced also with respect to the appointment of the Data Processor under article 28 of the GDPR for services and/or projects that are included in agreements or resolutions. ART-ER S. cons .p.a. (hereinafter also “ART-ER”) places the utmost importance on the protection of the personal data of users of their website www.art-er.it (hereinafter “Site”); this Privacy Policy, drafted in accordance with art.13 Regulation EU 2016/679 (General data protection regulation), illustrates ART-ER’s policy on the processing of personal data.

Personal data processed by ART-ER S. cons. p. a., purpose and legal basis
- Browsing data
The information systems and software procedures used to operate the Website acquire, during their standard operation, some personal data whose transmission is implicit to the use of the Internet communication protocols (Internet domain and IP protocol, type of browser and operating system of the computer used, date, time and duration of website visit, pages viewed, search engine (if any) used to access the site). These data are not collected in order to be associated with identified data subjects, however, due to their nature, they could make user identification possible through processing and association with data held by third parties. This category of data includes IP addresses or domain names of the computers used by the users that connect to the website, URI (Uniform Resource Identifier) addresses of the resources requested, request time, method used to submit the request to the server, size of the response file, numeric code indicating the status of the response given by the server (successful, error, etc.) and other parameters regarding the operating system and the user’s IT environment. These data are used only to obtain anonymous statistical information on website use and will be deleted immediately after processing, except where needed for crime investigation by Judicial Authorities.
- Information requests by users
When users request information, material and/or services through the various access channels and/or the forms in this website, ART-ER acquires the personal data of the subject. Such data will be processed by the Controller solely for the purpose of providing the information and/or the services requested. Providing personal data for the above purpose is optional, however failure to provide data or the provision of inaccurate data could make it impossible for the Controller to fulfil the requests.
- Subscribing to ART-ER’s newsletter
Pursuant to Article 6.c.1 a) Reg.EU 2016/679, you can subscribe to ART-ER’s newsletter using the special form, after giving your consent. The personal data you will provide will be processed by ART-ER for sending communications regarding ART-ER’s activities, services and projects to the email address supplied by the user. Provision of personal data for said purpose is optional, however failure to provide data or the provision of inaccurate data could make it impossible to correctly send the newsletter. The Controller specifies that the user can revoke its consent to the processing of data at any time by contacting ART-ER’s Controller or DPO at the addresses provided in this privacy policy.
- Work with us
Pursuant to art.6. c.1 (b) of Reg. EU 2016/679, the personal data provided through the “work with us” section will be processed for the purpose of carrying out the selection procedures for inclusion in ART-ER register of providers. Such data will also be processed for compliance with current applicable regulations, including audit and inspection activities, as well as for legal requirements on transparency and advertising. Provision of the applicant’s personal data is necessary in order to evaluate whether you meet application criteria and that you hold the qualifications required by specific selection procedures for inclusion in ART-ER’s Register of Providers. Therefore, failure to provide data or the provision of inaccurate data could prevent said evaluation and consequently exclude you from the selection process. Specific data processing notices may be included in some of the forms in this website’s pages.
Processing modalities
The personal data provided by users will be processed by ART-ER for the pursuit of its mission, for carrying out duties assigned to ART-ER by the Emilia-Romagna Region and for performing its institutional activities. To guarantee the security and confidentiality of the personal data processed, in accordance with the provisions of art.32 Reg. EU 2016/679 and the “Guidelines for governance of the regional information system”, ART-ER has taken adequate technical and organizational measures to reduce the risk of destruction, loss, unauthorized access or any processing of personal data that is not permitted or not in conformity with the purposes of collection.
Persons authorized to process data
The personal data you provide will be processed by authorized ART-ER personnel who have received adequate instruction on the measures, procedures and modus operandi for effective protection of your personal data.
Disclosure of data
Your personal data may be disclosed to local bodies and institutions who are legally entitled to request them. They may also be disclosed, for the purpose of processing, to external companies or professionals appointed by ART-ER as Data Processors pursuant to art.28 Reg. EU 2016/679 or persons authorized to process data hired by ART-ER for the performance of their activities. The list of Data Processors is available from the Controller upon request. Your personal data will not be transferred to countries outside the European Union. Your data will not be disseminated, except where online publication of personal data of specific categories of data subjects is required of ART-ER to comply with applicable transparency obligations.
Retention period
ART-ER will process your personal data for the period of time strictly necessary to pursue the purposes at the basis of processing, in full compliance with the retention obligations established by law.
